Vezmar Date Lawsuit

Despite all of the changes that have taken place concerning the dance of life between men and women, one thing that hasn't changed is the general expectation that the man is supposed to pay for the date, at least at first. A man who doesn't do that or tries to split costs before the woman is convinced that he's even worth any of her time or money is often derided as cheap or a loser. Good, bad or indifferent that's just how things are. Even many staunch feminists suddenly become Victorian England style ladies when faced with the idea of spending their money to meet men. If the man and woman don't like each other's company or independently decide that they'd be better off elsewhere or conclude that the date was a serious waste of time, money and resources then the man just has to eat the loss of whatever money he shelled out. And though it ought to go without saying, taking someone on a date doesn't guarantee anyone anything. Not one doggone thing. There is nothing implied other than the opportunity to determine if you like someone's company or not. If you spend $17 on a date but discover that someone is not up to your standards most people (men) would count that as the cost of dating and write it off to the game.

But 37 yr old Brandon Vezmar is not most men. Brandon went out on a date with a 35 yr old lady. Things didn't go well.

They went to watch Guardians of the Galaxy Vol 2. For whatever reason his date was apparently neither that enthralled by the movie nor interested in snuggling/talking with Brandon. She took out her phone and started texting. The number of times she did this is in dispute. What's not in dispute is her phone texting greatly annoyed Brandon, who asked his date to stop the texting or go out outside. His date chose to go outside. In fact she chose to go home. As she was the one who had driven Brandon to the theater her decision left Brandon without a ride home. And it apparently upset him so much that he tried to get her to pay him back for the cost of the ticket ($17.31 in total). When the woman declined to do so Brandon decided to sue her in small claims court.

AUSTIN - An Austin man is suing a woman for $17.31 after she allegedly texted throughout their movie date and left him at the theater, according to court documents. According to the documents, Brandon Vezmar met the Round Rock woman on Bumble, a dating app. They went on a first date to a movie theater to see "Guardians of the Galaxy." During the movie, Vezmar claims that she opened her phone between 10 and 20 times to read and send text messages.

This, Vezmar claims, is in "direct violation of the theater's police" and adversely affected "the viewing experience of Plaintiff and others." "I said 'listen, your texting is driving me a little nuts' and she said 'I can't not text my friend.' I said 'maybe you can take it outside to the lobby, I've seen people get kicked out movies for this," Vezmar explained.

The woman took his advice and left the theater, but did not come back. Vezmar is suing for compensation for the defendant's movie ticket, but he said the "principle is important as Defendant's behavior is a threat to civilized society."

KVUE spoke with the woman at the center of the lawsuit, who gave the following statement:

I did have a very brief date with Brandon, that I chose to end prematurely. His behavior made me extremely uncomfortable, and I felt I needed to remove myself from the situation for my own safety. He has escalated the situation far past what any mentally healthy person would. I feel sorry that I hurt his feelings badly enough that he felt he needed to commit so much time and effort into seeking revenge. I hope one day he can move past this and find peace in his life.

What's ironic about this is that Brandon is an apparent Trump supporter who has lauded Trump for standing up against the grievance industry. So now he's pursuing a grievance of $17.31 in court? Are the courts really the place to adjudicate every little harm that men and women do to each other? Although I get how a man would be annoyed if his date was not paying attention to him or the common activity they were supposed to be enjoying, I'm not sure how taking someone to court makes any difference here. But then I guess some people can get on your nerves to the point that you will look for any way to strike out. Getting left without a ride can make anyone lose their religion. And rude people who insist upon pulling out their smartphones at theaters despite all the signs and announcements beseeching them not to do that aren't the kind of people I want to hang around. I do think that if you are out with someone you owe that person your attention, absent some sort of family emergency. And no, your girlfriend fighting with her significant other doesn't count. The main "crime" though is leaving Brandon at the theater without a ride home. That is a pretty cold thing to do. Of course his date is stating Brandon made her feel unsafe. Who can say.

What's your take?

Can you think of anybody you'd like to sue?

Would you order the woman to reimburse Brandon for the ticket?

Would you throw this case out of court?
